Dog Walking Service Agreement
NOTICE TO THE PET OWNER/GUARDIAN:PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO
CREATE A CAUSE OF ACTION AGAINST AUSTIN STARK DOING BUSINESS AS GRATEFUL DOG WALKS), AND RELATED PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY AND UNDERSTAND ITS EFFECT, POLICIES, PROCEDURES, PET RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENTS.
In consideration for my pet(s) listed in the Time to Pet Client Portal, as a Customer of Grateful Dog Walks, by signing this document, I as Owner/Guardian, make the following representations, certify the accuracy of all information provided to Grateful Dog Walks at anytime, and agree to all the following Policies, Procedures, Terms and Conditions stated below in the Grateful Dog Walks Agreement, Policies, Procedures, Terms and Conditions.
Meet and Greet
Prior to beginning service a meeting will be scheduled to meet with the Client and the Clients Dog(s) in their home. This brief meeting is to let the dog meet the walker on familiar grounds and for the Client to meet who will be walking their Dog. This will be the time for both parties to ask any final questions, exchange any Keys or Passcodes, become familiar with where supplies for the pet are, and give instructions for what is expected of the Dog and Dog walker while in the home and out on walks.
Scheduling
Clients may make requests for the date(s), time, and type of service through the Time to Pet Client Portal or App. After making a request you will receive a confirmation message through the Time to Pet customer portal if your requested date and time are available. If not available the confirmation message will have the next available time closest to your original request. Clients are required to respond to the confirmation message to finalize the scheduling of the service for the requested time and date(s).
Dog Requirements
Must be fully vaccinated and current with tags on collar.
Must be on monthly flea and tick prevention.
Has been in good health for at least 30 days.
Must have a safe and strong leash.
Must have flat collar with tags (name, contact info, and rabies tag) *will walk dogs on harness if preferred but still requires collar*
Must have a Towel for post walk wipe down.
Must be friendly with unfamiliar people entering home.
Home Entry
One house key and/or key code is required to be given for entry to your property.
If you have a security system that will be active, location, instructions and code must be given.
All keys in possession of Grateful Dog Walks will be locked away when not in use and all codes and sensitive info will be kept confidential.
Keys will be given at the meet and greet or arranged for drop off by the client to Grateful Dog Walks before the start of service.
In the event entry to the Clients home is prevented due to the malfunction of keys, locks, automatic door, etc. Grateful dog walks will employ a locksmith on their behalf to gain entry, if attempts to contact the client fail. Reimbursement is to be made to Grateful Dog walks within 7 days of such an incident.
Walker may show up within a window of no earlier than an hour and no later than an hour from requested schedule time. Dogs will be wiped down after walking if weather or other environmental elements cause a dog to become wet or dirty. Grateful Dog Walks is not a grooming service. Walkers will do their best to wipe off and dry the dog(s). If a grooming service is requested Grateful Dog Walks can refer your dog(s) to one.
Client agrees to properly secure the home prior to leaving the premises. Grateful Dog Walks will re-secure the home to the best of its ability at the end of each visit.
Off Leash Policy
Other than medical emergencies, dogs will never be off leash unless the walker has developed trust with the dog and has written permission from the owner.
The dog must be in an enclosed area or in a rural setting that allows for an easy visual of the dog at all times and is far from major roadways.
Inclement Weather
In the interest of both your Dog and the Walker, walks longer than 15mins will not occur if temperatures are below 25F or above 95F, if there are High Winds, Heavy rain, or Thunderstorms that prevent normal walking conditions. In the event of Inclement Weather the dog(s) will be given a Potty Break and the remainder of time will be spent playing indoors.
Dog Walkers
For Consideration of service, the client agrees to not engage any of Grateful Dog Walks Employees outside of contracted services agreed upon with the company. Clients agree to communicate with walkers through the Time to Pet customer portal only.
Images, audio and/or video of Grateful Dog Walks Employees may not be shared or uploaded to the internet without expressed permission from the individual.
Emergency Care
Our Employees are trained in pet CPR and Pet First Aid and will administer such, at their discretion, in the event of a medical episode or injury. If possible, Grateful Dog Walks will bring the pet to the veterinarian of the clients choice as filled out in the Veterinary Forum. Grateful Dog Walks will make every attempt to contact the Guardian of the pet first. If the pet's guardian is unable to be reached then the emergency contacts will be contacted next for instructions. If unable to contact the pets guardian or the emergency contacts Grateful Dead Walks will bring the pet to the best Veterinary clinic/hospital based on their discretion and will follow the instructions given on the Veterinary Forum.
Medication
Grateful Dog Walks will only administer medication if given instructions to do so by the owner. In the event that a Veterinarian prescribes a pet medication while under the care of Grateful Dog Walks the owner will be contacted for permission before the administration of medication, unless otherwise approved of in writing. If the owner can not be reached Grateful Dog Walks will try and reach the emergency contacts for instructions. If no one is able to be reached Grateful Dog Walk will use its discretion based on the advice of a Veterinarian for the pets well being.
Payment
Payments can be made in person using cash or check , or electronically through the Time to Pet Client portal. Client agrees to pay for all services prior to or at commencement of service. For recurring services, Grateful Dog Walks will provide a weekly invoice that is to be paid prior or at the commencement of service for that week. Client will incur a $25 charge for each returned check in addition to any and all bank fees attributed to the returned check.
Holiday Fee: Add $8 per visit
Observed Holidays are: New years eve and New years day, The Friday before Memorial day and Memorial day, The Fourth of July, Labor Day, Thanksgiving and the day after Thanksgiving, and Christmas Eve, Christmas, and the day after Christmas.
Cancellations
Cancellations can be made in the Time to Pet Customer Portal.
Grateful Dog Walks reserves the right to charge a cancellation fee of 100% of the scheduled visits for services canceled within less than 24 hours’ notice prior to the scheduled service and a fee of 50% if within less than 5 business days prior.
Cancellations during holiday seasons / weeks need to be canceled within 10 business days prior to scheduled service. A cancellation fee of 100% of the scheduled visits for services canceled within less than 10 business days prior to the scheduled service during holiday seasons / weeks.
TERMS AND CONDITIONS
I represent that my pet has not had any contagious illnesses of any kind for 30 days prior to the start of service date. I am aware and understand that Grateful Dog Walks’ employees are not veterinarians and do not have backgrounds in animal medicine. Grateful Dog Walks’ employees cannot diagnose or detect illnesses in the client’s pets under Grateful Dog Walks care. I agree to assume all risks associated with the administration of medication by Grateful Dog Walks services. I acknowledge and am aware that vaccines do not protect my dog against all contagious illnesses that may affect my pet. I HEREBY AGREE TO INDEMNIFY GRATEFUL DOG WALKS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS AS A RESULT OF MY FAILURE TO INFORM GRATEFUL DOG WALKS OF ANY PRE-EXISTING MEDICAL CONDITION MY PET MAY HAVE.
I agree to let Grateful Dog Walks obtain veterinarian medical treatment for my pet, if, in its sole discretion, it appears that the pet is ill, injured, or exhibits any other behavior that would reasonably suggest that the animal needs medical attention. Medical treatment may require transportation of my pet to receive that medical care and I hereby authorize that transportation. I grant Grateful Dog Walks full authority to make decisions on medical treatment of my pet if attempts by Grateful Dog Walks to contact me are not successful. I agree I am fully responsible for any such medical treatment and transportation costs. I agree I am assuming all risk of illness, disease, harm, or otherwise to my pet by allowing my pet to participate in services with Grateful Dog Walks. Furthermore, I agree I am assuming all risk of consequences associated with any decision made by Grateful Dog Walks, relating to medical care and transportation of my pet.
I agree that if my pet is transported to or from Grateful Dog Walks services by Grateful Dog Walks, its employees or agents that I AGREE TO HOLD GRATEFUL DOG WALKS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS HARMLESS IN THE EVENT OF INJURY OR ACCIDENT DURING TRANSPORTATION.
I agree to be solely financially responsible for any and all acts or behavior of my pet while in the care of Grateful Dog Walks, WHICH MAY INCLUDE PAYMENT OF DAMAGES FOR THE INJURY CAUSED BY MY PET TO OTHER ANIMALS, HUMANS, AND/OR GRATEFUL DOG WALKS. IN ADDITION, I AGREE THAT IF MY PET IS INJURED BY ANOTHER PET, I HEREBY RELEASE GRATEFUL DOG WALKS, ITS OWNERS, EMPLOYEES, AND AGENTS FROM ALL LIABILITY AND FINANCIAL RESPONSIBILITY FOR SUCH INJURY. I FURTHER UNDERSTAND THAT IF MY PET BITES A HUMAN OR PET, THAT GRATEFUL DOG WALKS MAY CONTACT THE APPROPRIATE AUTHORITIES.
I understand that Grateful Dog Walks may be utilizing playgroups where multiple dogs interact. I understand that dogs play with their mouth and paws, which can result in nicks and scratches on my pet. While Grateful Dog Walks provides reasonable care and supervision in the playgroups, I understand and agree that Grateful Dog Walks employees may not notice these nicks or scratches, and therefore I might not be notified.
I agree to notify Grateful Dog Walks of any concerns within 24 hours.
I certify that my dog is not aggressive and I understand that aggressive dogs are not permitted to participate in services at Grateful Dog Walks. If my dog acts aggressively or exhibits unacceptable behavior, he/she may be separated from the other dogs. I authorize Grateful Dog Walks to use squirt bottles, and in extreme cases muzzles and/or physical restraining techniques to control my pet for their own protection and the protection of other Animals and humans.
I agree to allow Grateful Dog Walks to use my pet’s name and any images or videos taken while he/she is in the care of Grateful Dog Walks, in any form or format, for use, at any time, in any media, marketing, advertising, illustration, trade or promotional materials.
I agree that Grateful Dog Walks shall not be responsible or liable for any lost, stolen or damaged personal property belonging either to my dog or me.
I represent that I have disclosed and shall continue to disclose, any and all medical conditions or any other conditions, including, but not limited to, personality concerns or behaviors that may affect, limit, or prevent my pet’s ability to participate in services provided by Grateful Dog Walks. I understand that Grateful Dog Walks is relying on and will rely on those representations to provide a safe environment for both humans and animals.
I understand that Grateful Dog Walks can terminate this contract if my pet becomes a threat to the safety or health of Grateful Dog Walks or the community due to aggressive behavior.
Grateful Dog Walks reserves the right to refuse service to any client, at any time, for any reason.
Grateful Dog Walks agrees to provide pet sitting, dog walking and other applicable pet care services in a reliable, caring and trustworthy manner. In consideration of the services and as an express condition thereof, THE CLIENT EXPRESSLY WAIVES AND RELEASES GRATEFUL DOG WALKS FROM ANY AND ALL CLAIMS AGAINST THE COMPANY, ITS OWNERS, EMPLOYEES AND REPRESENTATIVES, EXCEPT THOSE ARISING FROM NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PET SITTING COMPANY.
In the case of an emergency, inclement weather or a natural disaster, the Client authorizes Grateful Dog Walks to use reasonable judgment for the care and well being of Client’s pet(s) and residence. Grateful Dog Walks will make reasonable efforts to maintain service during these conditions but reserves the right to adjust the schedule of service based on the sole discretion of the Dog Walker.
This document gives Grateful Dog Walks and its representatives authorization to enter the Client’s listed address as needed to perform agreed upon services.
Client expressly gives Grateful Dog Walks the authority to employ a locksmith on their behalf and to promptly reimburse Grateful Dog Walks for all costs incurred (within 7 days) in the event of a malfunction of the lock, keys or automatic door opener.
Client is responsible for supplying the necessary equipment and supplies needed for the care of their pet(s) including, but not limited to, a sturdy, well-fit harness or collar and leash for walks or in case of emergencies, pet food, medications, identification tags, litter boxes, cat litter and cleaning supplies. Client authorizes any purchase necessary for the satisfactory performance of duties. Costs of all purchases and related service fees will be reimbursed to Grateful Dog Walks within 7 days.
I RELEASE, WAIVE, DISCHARGE, INDEMNIFY AND AGREE TO HOLD GRATEFUL DOG WALKS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS HARMLESS FOR ANY AND ALL MANNER OF DAMAGES, INJURY, CLAIMS, LOSS, LIABILITIES, COSTS OR EXPENSES, ATTORNEY’S FEES, CAUSES OF ACTION OR SUIT, WHATSOEVER IN LAW OR EQUITY, ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED BY GRATEFUL DOG WALKS, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS INCLUDING WITHOUT LIMITATION: ANY INACCURACY IN ANY STATEMENT MADE BY MYSELF OR INFORMATION PROVIDED BY ME TO GRATEFUL DOG WALKS, MY PET, INCLUDING BUT NOT LIMITED TO DESTRUCTION OF PROPERTY, DOG BITES, INJURY, AND TRANSMISSION OF DISEASE, AND ANY ACTION BY MYSELF THAT IS IN BREACH OF THE TERMS OF THIS AGREEMENT.
The Term of this document applies to all pets owned by the client, including any and all new pets that the customer obtains on or after the date this document was signed.
Grateful Dog Walks reserves the right to change and update terms of this agreement in the future. Notice will be given to clients upon publication of changes.
Each time I request service by Grateful Dog Walks, I am re‐affirming the terms of this agreement, and the truthfulness and accuracy of all the statements I have made in this agreement. I HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT AND UNDERSTAND THAT I WILL GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT. I HAVE SIGNED THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY OF GRATEFUL DOG WALKS 208 W Eiche ave, effingham IL, 62401, OWNERS, AGENTS, AND EMPLOYEES TO THE GREATEST EXTENT PERMITTED BY LAW. I FURTHER AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE, THE REMAINDER OF THIS AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.
Any violation of the aforementioned terms will be considered a breach of contract. The agreement is listed above in its entirety.
